Troværdighed. Det var ikke fuldbyrdet voldtægt, det var fuldbyrdet justitsmord. Hvordan kommer parterne videre?

I fredags afsagde Vestre Landsret dom i en sag om tre indvandredrenges påståede voldtægt af en ung dansk pige på banegården i Fredericia. De tre drenge, der oprindelig var blevet dømt og i fuld gang med afsoningen, blev nu alle frifundet, fordi nye oplysninger i sagen viste, at pigen havde opdigtet voldtægten og afgivet falsk vidneforklaring. Drengene er derfor gået fri, mens den 15-årige pige nu er sigtet og risikerer en dom på i hvert fald betinget fængsel.

Sagen – som jeg skrev om her i avisen den 5. februar 2010 – er spektakulær, fordi de nye oplysninger fremkom ved at den påståede hovedgerningsmands storebror satte sig for at rehabilitere sin lillebror. Han opsøgte derfor pigen, vandt hendes fortrolighed, og optog i al hemmelighed flere samtaler med hende, hvor hun omhyggeligt indrømmede at have løjet, fordi hun fortrød at hun var gået med til at have sex på et banegårdslokum til gengæld for penge til en busbillet. Da drengene var blevet dømt uden tekniske beviser, men alene på grundlag af pigens udsagn, som domstolen fæstede lid til, åbnede indrømmelsen om løgn naturligvis for en ankesag.

Anklagemyndigheden fastholdt at drengene var skyldige, men i fredags blev de altså alligevel frifundet for voldtægten med dommerstemmerne 4-2. Der er altså stadig to dommere der mener, at pigens oprindelige forklaring er korrekt, selvom hun har erkendt – på de skjulte bånd som den voldtægtsdømtes storebror optog i skjul – at have løjet, og selvom der mangler tekniske beviser. I retten sagde pigen, at hun var blevet instrueret i at sige at hun havde løjet af den dømtes storebror, men det fandt et flertal altså utroværdigt.

At afgive falsk vidneforklaring er en meget alvorlig sag, fordi det kan føre til justitsmord – som i dette tilfælde, hvor drengene blev dømt hårdt for noget, som de ikke havde gjort. Jo, den ene havde haft sex med pigen på banegårdens toilet, men det var ikke tvang og voldtægt. Pigen gik frivilligt med til samlejet, hvorefter hun fik moralske skrupler og besluttede sig til at tage hævn over i hvert fald én af drengene, som havde sparket til hendes trusser i toilettes forhal. Det førte så til den falske historie om voldtægt.

Den ulykkelige sag rejser mindst to ubehagelige spørgsmål, hvor det ene rummer en juridisk tragedie, det andet en social tragedie:

1) Hvordan kan det være, at retten fæster mere lid til en dansk pige, der lyver, end til tre indvandrerdrenge der fortæller sanheden, når der ikke foreligger et eneste teknisk bevis, der understøtter pigens forklaring?

2) Hvordan kan de være, at en dansk pige fra en god familie (antager jeg,
jeg kender jo ikke familiens indre liv, men faren er paradoksalt nok jurist ved retten i Kolding, hvor sagen var for) prostituerer sig på et banegårdstoilet?

For det første: Retsformanden og domsmandsretten havde – som sagt – ingen tekniske beviser at støtte sig til, i hvert fald ingen beviser, der trak i retning af drengenes skyld. Tværtimod var pigen uden fysiske tegn på voldtægt, og opmålinger på det påståede gerningssted viste faktisk, at den hovedanklagede (og dømte, nu løsladte) dreng rent faktisk var for lav til at gennemføre en stående voldtægt af pigen, der efter egen forklaring havde siddet på toilettets håndvask. Derfor blev skyldsspørgsmålet afgjort alene udfra de impliceredes troværdighed – og her mente domsmandsretten altså, at pigen var troværdig nok til at sende drengene i fængsel.

Hvorfor? Sandsynligvis fordi de tre indvandrerdrenge havde en dårlig sag på forhånd, uanset deres uskyld. For hvordan skal man dog tro, at en dansk teeangepige hvis far i øvrigt er jurist ved retten, kan finde på at sælge sex på et banegårdstoilet til gengæld for penge til en busbillet? Det ønsker ingen at tro, heller ikke retsformanden og domsmandsretten. Men når sagen alligevel er pinlig for systemet, skyldes det fraværet af tekniske beviser til fordel for anklageren. Tværtimod trak de tekniske beviser den modsatte vej. Drengene blev ikke alene dømt på forhånd, de blev også dømt på fordom. De ville derfor have været fuldendte ofre for et justitsmord, hvis ikke det var lykkedes for den enes bror, at få pigen til at indrømme sine egne løgne på en skjult optagelse.

For det andet: Når en pige i teenagealderen – ifølge drengene – har et lokalt ry for at sælge sig selv til sex, og når kommunale socialrådgivere ifølge drengenes forsvarer Mette Grith Stage taler om, at det ikke er ukendt at helt unge piger giver ”et blowjob for en Big Mac”, ja så er der naturligvis tale om en foruroligende social krise, som pigerne skal hjælpes ud af. Ved vi nok om dette fænomen – om hvorfor pigerne prostituerer sig på denne måde, om hvem der lokker dem til det og fastholder dem i det?

Sagen fra Fredericia Banegård var ikke fuldbyrdet voldtægt. Men sagen fra Retten i Kolding var fuldbyrdet justitsmord. Indtil den dømtes bror kastede sig ud i privat efterforskning. Systemer kan tage fejl, også retssystemer, og domsmandsrettens medlemmer må derfor spørge sig selv, om deres oprindelige troværdighedsvurdering var præget af fordomme – både om forventeligt kriminelle indvandrerdrenge og om en dansk, pæn pige.

Det store spørgsmål er: Hvordan kommer parterne videre? Drengene er juridisk rehabiliteret, og der venter dem en erstatning. Pigen, derimod, står måske overfor en dom for falsk vidneforklaring. Uanset hvad, vil sagen klæbe til dem fremover. Men for dem alle gælder, at de er ganske unge, og at de har fremtiden for sig. Det bør denne ulykkelige konflikt ikke ødelægge. Sagen råber på mæling og forsoning, på et møde mellem pigen og drengene, hvor de sammen med en rådgiver kan tale tingene igennem, sige undskyld til hinanden (for drengene bør naturligvis undskylde for overhovedet at have taget initiativ til en sexhandel med tyve kroner til en busbillet som indsats!) og udveksle løfter om gensidig respekt i fremtiden. Lad os få en blød landing på en hård sag. De unge fortjener en mulighed for at komme videre.
